Unions Win Order Against MultiCare Payroll Deductions

FOR IMMEDIATE RELEASE

Seattle — Last month, a judge in King County Superior Court handed down an order that said MultiCare cannot deduct money from workers who were temporarily overpaid without an express agreement from the individual employee. The alleged overpayments related to an extended outage of the employer’s timekeeping system.

SEIU Healthcare 1199NW, UFCW 3000 and the Washington State Nurses Association filed suit against MultiCare after the healthcare system announced it had overpaid workers and was going to recover the overpayments by deducting amounts of their choosing from subsequent paychecks without the permission of the worker. The unions argued the law didn’t permit MultiCare to do that. The court agreed with the unions, and MultiCare was ordered to stop deductions unless it had an agreement with the individual member.

The Washington State Nurses Association, SEIU Healthcare 1199NW and UFCW 3000 filed a Temporary Restraining Order (TRO) in March to prevent MultiCare Health System from garnishing wages without employees’ consent in order to recover alleged overpayments while the case made its way through the court system.

This legal win will make a world of difference to dozens of workers who were facing drastic deductions from their checks. It would have meant not being able to pay rent or mortgage or keep food on the table if MultiCare had been allowed to proceed with the deductions.

These legal actions are intended to ensure that employees have a fair, transparent, and collaborative process for establishing repayment plans, including an opportunity to challenge MultiCare’s accounting and have a say in their individual repayment plans. Under federal labor law, MultiCare must bargain with the unions to ensure a fair procedure for any repayments.

BACKGROUND

In December 2021, timekeeping software provider Kronos was hit by a ransomware attack, shutting the system down for many employers that use it. During the time Kronos was offline, MultiCare chose to duplicate employees’ last accurate timesheet for payroll purposes.

Employees continued to track hours separately outside of Kronos, but paychecks for four pay periods were based on the first pay period in December.

MultiCare knew from the start that this would result in inaccurate paychecks during the outage, as healthcare worker hours vary, sometimes significantly, week to week. Notably, the period of outage covered the worst months of the Omicron surge, during which employees saw significant upheaval in their schedules.

Following Kronos’ recovery, MultiCare announced that it would begin deducting up to $500 per paycheck without employee consent beginning March 18. MultiCare gave workers a March 9 deadline to request alternate payment plans but did not offer an option to repay by any means other than paycheck deductions, and the lowest amount offered was 10% of the amount allegedly owed per pay period. At the same time, MultiCare has not provided transparent accounting for its claimed overpayments (or underpayments), and numerous workers have reported inaccuracies in the accounting provided to them.

MHS Covington Medical Center (Service, Technical & RN) WAGES UNANIMOUSLY APPROVED!

UFCW Local 21 members at Covington Medical Center unanimously voted to approve their proposed wage increases yesterday, Thursday, January 13,

The proposed increases will become effective Sunday, January 16; however, the Employer has warned that the Kronos outage could cause a slight delay in member’s seeing the difference in their paycheck.

Now we must prepare for contract negotiations later this year, which will be another opportunity to further increase wages and work on solutions to other workplace issues.

One of the best things you can do to prepare for upcoming negotiations is to sign up for a Steward training! In Steward training, you will learn your rights and protections and how to push back against unfair practices by management. You will also learn how to represent a coworker in a disciplinary meeting and uphold your contract.

MHS Covington Hospital Bargaining Update (All Units) - EMERGENCY WAGE INCREASE TALKS BEGIN

We are pleased to report that talks have begun with Management for emergency wage increases for all UFCW 21 represented positions at MultiCare’s Covington Medical Center.

While we are not scheduled to start contract negotiations until later next year, today’s tight labor market has resulted in recruitment and retention issues that require immediate action on wages in order to stay competitive with neighboring hospitals. This is further necessitated by the wage increases that we negotiated earlier this year at other UFCW 21 facilities such as Auburn Medical Center and Tacoma General Hospital.

With this in mind, we were happy to hear from the Employer in an email to the Union on December 21 that they wanted to begin talks to increase wages before contract negotiations.

While we will work to expedite the process, we must still ensure that any proposed changes to our wage scales are fair and equitable for all members. Furthermore, any proposed changes to our wage scales will also require a full vote of UFCW 21 members at Covington Medical Center before they can be implemented.

We have requested additional information from the Employer and are working as quickly as possible to conduct a comprehensive analysis of possible solutions.

Capital Medical Center Bargaining Update - MultiCare is failing our community

Your Bargaining Team met with Management again on November 17 and December 8 to continue negotiations for your successor contract.

After much delay, the Employer finally provided an economic counteroffer that included increases to wages and various differentials. It was not worth the wait. Management’s proposal not only fails to bring our wages to market standards, but it also fails to consider today’s historic inflation rate that has caused the price of everything from groceries to gasoline to skyrocket.

MultiCare acknowledged in our meeting that LifePoint (your previous Employer) had a very different style of management that focused on depressing workers’ wages, which resulting in today’s uncompetitive wage scales. However, in the same breath, Management stated that they do not plan on fixing the problem with this contract, willing to maintain the status quo of low wages at Capital Medical Center for the next three years.

Your Bargaining Team challenged them by pointing out that we are in a staffing crisis that is in most part caused by wages. We also reminded them that we’re currently going through what is now being called the “Great Resignation,” with employees easily finding new jobs with significantly higher pay and oftentimes a hefty signing bonus. Failure to raise our wages to market competitive rates will likely lead to many employees looking for positions elsewhere.

To make matters worse, MultiCare has also maintained their demands for contractual takeaways. They continue to demand that we cut your Extended Illness Bank (EIB) accruals by about 40%, adopt a new PTO system that would negatively impact nearly 50 employees, and remove the day after Thanksgiving as a paid holiday.

MultiCare cannot place the blame on LifePoint when MultiCare is the one refusing to offer fair wage increases, when MultiCare is proposing benefit takeaways, and when MultiCare is refusing to invest in Capital Medical Center. So long as they continue this behavior, MultiCare will continue to fail our community.

We will meet with the employer again on December 20 and are working to schedule additional dates into the new year.

We’re excited to announce that Nurses at Auburn Medical Center overwhelming voted to ratify their new contract yesterday! As a reminder, our new contract includes:

Unprecedented wage increases, giving Auburn Medical Center one of the highest RN wage scales in Washington State. Includes full retro pay back to August 15, 2021!

Some of the highest premiums in the region with increases to shift differential, standby pay, weekend premium, charge nurse pay, preceptor pay, and float pay.

Maintained annual bonuses for members at the top of the wage scale.

New language that forbids the Employer from forcing nurses to float to other hospitals,

Improved charge nurse language allowing nurses to object to the assignment,

And so much more!

Auburn Medical Center RNs Bargaining Update

We met with the Employer again on September 14, and it was one of the more productive days of negotiations thus far. After expressing our frustration with Management’s constant delays, we’re pleased to report that they were ready to accept the Union’s proposal first thing in the morning.

In our proposal, we continued to push the narrative that our new contract should include a wage scale that is not only competitive today but will remain so for the entire three-year duration of the agreement. Nurses are being worked to the point of burnout because of the staffing crisis and our wage proposal would make it easier for the Employer to hire and retain staff, providing much needed relief.

We’ve also held firm on our demand that members receive some form of compensation as a result of the delays caused by Management. Our contract was originally scheduled to expire last month, which is when we should have received our wage increases. Therefore, each day that passes without an agreement is more money the Employer is pocketing that should have been added to our wages.

MultiCare - Salaried Float Pool and Mandatory floating

It has come to the Union’s attention that MultiCare has implemented a Salaried Regional Labor Pool and a new Mandatory In-House Floating Policy. 

The Salaried Regional Labor Pool was created last month, which provided salaried non-union workers significant incentives to perform our bargaining unit work. At no point did the Employer provide notice to the Union regarding this change. It is our position that such actions are violations of our contracts, which prohibit non-union workers from performing our work with only a few specific exceptions (per diem, travelers). We’re frustrated that management has decided to not only violate our contract, but also pay large incentives to the salaried workers that could have otherwise been paid to our members to work the extra shifts. 

We also have significant concerns about the Employer’s new Mandatory In-House floating policy, which will result in employees being mandated to float outside the limitations of our contracts.
The employer has already admitted that this new policy will likely result in violations, and they seek to reach a special agreement to grant them flexibility. Despite their request for a special agreement, management has already implemented the program before we’ve even had a chance to meet and bargain over the policy.  

The Union sent cease and desist letters to MultiCare regarding both the Salaried Regional Labor Pool and Mandatory In-House floating policy; however, they have stated their intention to disregard our requests. Consequently, the Union has filed grievances against the Employer demanding that members be made whole for any lost hours/wages as a result of these violations. We’ve also informed the Employer that we reserve the right to file unfair labor practice charges with the National Labor Relations Board (NLRB) over their actions. 

While we understand and share the Employer’s concerns about the large patient census driven by the current surge in COVID-19, we firmly disagree that such conditions warrant violations of our contracts nor waive the Employer’s obligation to bargain over a change in our member’s working conditions before implementation. We are committed to working together with the utmost urgency to come to an agreement over these matters in a way that ensures the community continues to receive high quality care while, at the same time, honoring Management’s obligations under our contracts.

We are scheduled to meet with the Employer early next week to discuss these matters further.

MultiCare Auburn Medical Center RNs: Bargaining makes some progress

We met with the Employer again on August 24 hoping for a more productive meeting than we’ve had in the past. Unsurprising, we were disappointed.

While the Employer did provide their first economic counteroffer, they have still failed to respond to a number of our other proposals that were provided to them over a month ago. This only adds to our frustration with Management after their delays on getting dates scheduled in the first place. The Mary Bridge nurses, whose contract was scheduled to expire the same day as ours, have had double the bargaining dates as we have had. Are we not a priority to MultiCare?

However, there is good news to report. Management’s first economic response was not bad, especially considering that an initial economic offer from an employer is usually insultingly low. Their proposal would put our wage scale at about market standard, slightly above the RN scale at a neighboring hospital. This is a surprising initial offer, but your Bargaining Team is pushing for a contract that will remain competitive over the next couple years.

Our member Bargaining Team met with management on August 3 and 24 to kick-off negotiations.

We are frustrated that it took so long to get the employer to agree to these initial dates, which meant negotiations began only a few days before our contract was set to expire. We have signed an extension agreement to ensure that our contract remains in place, but we shouldn’t have had to wait so long to get this process started.

We presented our first proposal to the Employer on August 3, which included proposals to improve our existing language on issues regarding staffing, charge nurse assignments, accepting extra shifts, floating, and more. We also made a proposal to add the spot bonus incentive program to our contract.

The Employer provided a response to most of our proposals on August 24. While they did agree to some proposals that were already settled during the technical bargain, they pushed back on most everything else. For example, they wanted to strip out most of language that allows for members to report staffing concerns to administration without going through the staffing committee. While the staffing committing is a strong tool, we need to preserve alternative avenues for members who are not on the committee to have their concerns addressed.

Afterwards, we gave the Employer a comprehensive economic proposal. As we were crafting this proposal, we reviewed neighboring facilities such as Valley Medical Center who are direct competitors in the labor pool. Our proposal reflects the need to increase wages enough to ensure that management can easily attract and retain high quality staff at Auburn Medical Center.

We eagerly await the Employer’s response.

Our Bargaining Team will meet with management on August 24, then again September 8, 14, 22 and 29.

MultiCare Contracts Ratified!

We are excited to announce that UFCW 21 members at MultiCare voted to ratify their new contracts on Monday August 16!

Our new contract includes historic wage increases, significant wage scale restructure that puts more money in member’s pockets, protections against major increases to our health care costs, improved staffing language, and so much more. You should expect to see your new wage in the next few pay periods, but remember that they are effective back to May 23, which means you should expect to receive a sizable retro check as well.

Our Bargaining Team would like to thank the community who showed management that they will ALWAYS support health care workers. Community leaders showed up in numbers at our actions, speaking out against management’s behavior throughout this campaign and demanding a fair contract.

They will be happy to hear that MultiCare workers have just ratified one of our best contracts in years.

MultiCare - Tentative Agreement Reached! Contract Vote Scheduled

After seven months of bargaining, we have reached a tentative agreement with MultiCare! The Bargaining Team unanimously recommends a “YES” vote on this agreement.

Highlights of the agreement include:

• Three-year contract,

• Historic wage increases at ratification with partial retro,

• Significant wage scale restructure that puts more money in member’s pockets,

• Increases to several wage premiums,

• No healthcare premium increases in 2022 with caps on future years,

• Improved schedule posting language,

• Streamlined process to report staffing issues to administration,

Management’s offer didn’t include any surprises and, while they didn’t agree to most of our proposals, we do feel that progress was made. In fact, we were able to come to agreements on a couple of minor language amendments to both preceptor pay and the conference committee.

We responded to their offer by adding several new proposals, including: 

  • NEW wage premium when floating outside of Mary Bridge Children’s hospital...

  • NEW language to establish stable/regular scheduling practices...

  • Removal of the “callback that overlaps a scheduled shift” loophole...

  • Increased continuing education money with annual roll-over of unused funds...

  • ...and enhancements to our incentive pay programs.

Your Bargaining Team is still working on an economic proposal, which will include proposed wage increases that would make Mary Bridge more competitive with neighboring hospitals. We plan to have our wage proposal ready when we meet with the Employer again on July 30.

We are happy to announce that we’ve come to an agreement on a new $1.00/hr wage premium for anyone holding a Bachelor of Nursing (BSN), Master of Nursing (MN), Master of Science in Nursing (MSN), or PhD. Our agreement to create a new BSN differential is effective immediately, however, to qualify you’ll have to submit proof of completion (degree or transcript) to the Employee Resource Center. MultiCare - Extra Bargaining Date

Your bargaining team met with management again on July 6 after the employer agreed to add an extra bargaining date to the calendar. 

We are happy to report that some progress was made as the Employer made noticeable movement on wages, reducing the number of people receiving less than a 2.5% wage upon ratification. While this is hopefully movement, their current offer still leaves many members behind with some still receiving less than a 0.50% increase upon ratification. The employer also continues to refuse paying these raises retroactively back to contract expiration (3/01/2021), instead offering a small $200 ratification bonus.

MultiCare also made no movement on our healthcare priorities, only offering to limit premium increases to no more than $40/month each year, which would give the employer the power to raise your rates by up to $120/month by the end of a three-year contract. Members made clear in the bargaining survey that we need to fight to make our healthcare plans affordable and accessible, and that’s exactly what we’re doing. 

They are also holding firm on several management power grabs. One of management's proposals is the addition of language that would allow them to implement new incentive pay programs without having to bargain with the Union. While incentive pay plans are a great tool to deal with staffing issues, we have rights as Union members to have a say in how they are implemented.

For example, a few months ago it came to the Union’s attention that MultiCare had implemented an incentive pay plan for RN’s that was ripe with issues. It was so bad that some members were reporting that extra shifts were being awarded unfairly to management’s friends via Facebook Messenger rather than through official channels. The Union demanded to bargain, and we eventually reached an agreement with management that ensured extra shifts were being fairly awarded to all eligible nurses along with other fixes to the plans many issues. Management wants to strip away your power to have a say in these decisions, a core Union right, which is unacceptable.

Your Bargaining Team shared these concerns with the community during our Rally @the Park. We’d like to thank our community partners who showed up to support MultiCare Workers: Fuse Washington, Asian Pacific Labor Alliance, Union of American Physician and Dentists, UFCW Local 367, Tacoma Ministerial Alliance, and Catherine Ushka from the Tacoma City Council. Capital Medical Center - We Have Reached an Agreement with MultiCare!

On April 1, 2021, MultiCare acquired Capital Medical Center from LifePoint. The Union was notified in February 2021 by MultiCare that they would be acquiring Capital Medical Center and we asked to bargain over the acquisition. Under the National Labor Relations Act, when a business is acquired by another company, the new company has the option of recognizing the current union contract or bargaining a completely new agreement. MultiCare agreed to most of our current contracts for the RN and Service/Tech/Office units, but wished to bargain over PTO, pay period, holiday worked premiums, and health benefits. 

We identified that under MultiCare’s proposals health insurance premiums would increase, and PTO accruals would decrease for full-time employees. We made proposals to provide bonuses to the two units to offset the health insurance premium increases and maintained that PTO accruals remain at status quo. MultiCare continually rejected our proposals around health insurance but accepted to keep PTO at status quo. 

As a team, we decided that the new health insurance plans were a slight improvement and that we will fight for reduced health insurance premiums in a few months for the Service/Tech/Office unit and we will bargain in 2022 for the RN unit. Additionally since April 1, MultiCare has incorrectly calculated full-time employees PTO. They have agreed to correcting everyone’s PTO accruals, but first must build a payroll system to calculate accruals. These accruals should be corrected by or before September 2021. 

Given that there are changes to the current contract, both units must vote to ratify the agreement. We will be voting on July 20 online from 12:01 AM to 8 PM. All union members in good standing will receive an email from Simply Voting on July 20 at 12:01 AM with a unique login ID to vote online.

Join the UFCW 21 Bargaining Team, MultiCare workers, Pierce County Movement Builders, and community leaders for a Rally @the Park to support employees at MultiCare who are currently fighting for a fair contract. 

We have been in negotiations with MultiCare since January for contracts that cover healthcare workers at Tacoma General Hospital, Mary Bridge Children’s Hospital, Allenmore Hospital, Auburn Medical Center, and various clinics in King & Pierce County.

Unfortunately, MultiCare continues to push an inequitable economic proposal that would give some healthcare workers less than a 0.50% wage increase at ratification and would allow Management to increase our healthcare premiums by up to $120 a month over the next three years. To make matters worse, Management has been sending out false and misleading statements to Union members, leading the Union to file an Unfair Labor Practice (ULP) charge against the Employer.

Your Bargaining Team just finished three long back-to-back days of negotiations with MultiCare in the hopes of reaching a deal on a fair contract that would benefit all our members. Unfortunately, we concluded our last session just before midnight on June 24 without an agreement.

While we are pleased to report that there is a significant amount of money on the table, that money is not being distributed equitably amongst all employees. The employer’s last economic proposal did include large wage increase for some members; however, other members would receive less than a 0.50% wage increase. MultiCare will tell you that the average wage increase is high but there is a good chance you won’t get anything close to their average. The people at the top of the wage scale, who are the most experienced and dedicated employees, are the employees most likely to receive an insultingly low wage increase with the employer’s proposal.

Management is also demanding that the Union increase management’s control over our member’s wages. For example, management wants to have the authority to bring in new employees at a higher wage without having to increase the wages of all existing employees. Does that seem fair to you?

To make matters worse, the employer has refused to implement wages retroactively back to contract expiration (3/01/2021) and instead proposed an insulting $200 ratification bonus. They’ve also continued to reject our COVID-19 Hero Bonus proposal, refusing recognize the significant risks that healthcare workers and their families experienced on the front lines of the pandemic. In fact, never once has management acknowledged these risks during any of our bargaining sessions, as if they are pretending it never happened.

Your Bargaining Team has been working tirelessly to restructure our wage scale in a way that would help with the hiring and retention of workers, which would address the staffing issues that members have reported to be of the utmost importance. However, we must be very careful to make sure that any such changes would provide fair wage increases to all our members not only today, but into the future as well.

Apart from wages, members ranked the affordability and access of healthcare as a top priority on the bargaining survey. We have been fighting for months to address these problems with proposals to rein in the constant preimum increases and to make it easier for members to qualify for health insurance. Managament has shown an unwillingness to make any significant movement on healthcare, only agreeing to limit annual premium increases to no more than $40 more each month. That would mean management would have the right to raise your premiums rates by up to $120 a month by the end of a three-year contract.

In addition to the above, management is proposing the removal of President’s Day as a holiday, new PTO-ws language that makes it easier to lose PTO, elimination of the Respiratory Therapist incentive pay program, and other power grabs that would increase management’s control.

Do not trust management when they claim to be offering a good deal, what they are offering is unacceptable. In fact, their June 18 bargaining update to you included so many factual inaccuracies that the Union filed an Unfair Labor Practice charge against the employer for lying to and misleading their employees. Now is the time to fight, time to show the employer that we will not accept an offer that leaves so many behind.

Our next bargaining dates are not until July 28 and 29, which are further away than we would prefer. We requested additional dates between now and July 28, but the employer never responded to our request.

MultiCare Bargaining Update Progress at Last

After months of a virtual statement, we finally started the mediation process on May 25.

What is mediation? Mediation is when the Union and Employer have reached a point when little progress is being made, the parties have the option to bring in a neutral third-party mediator to help move things along. The federal government provides a free meditation service (FMCS) that works exclusively on union-employer disputes and has assigned a mediator to help us reach a deal with MultiCare. The role of the mediator is to help the parties better understand the other’s point of view and to push both sides towards an agreement.

So far it’s working. While we are still far apart, we have seen the most significant movement from the employer we have seen since we started in January. The mediator seems to have been doing a good job of forcing the employer to hear and understand our concerns. We noticed the most movement on economics with the employer being more resistant to our non-economic proposals. Our action last month, and the outpouring of community support since then, has certainly been a continuing factor to the movement.

This is very encouraging news, but don’t celebrate just yet. We still have many outstanding issues to resolve (staffing, PTO, wage premiums, floating, preceptor pay, seniority, extra shifts, etc) before we can reach a deal. And while the employer has put more money on the table, we are still worlds apart on our wage proposals.
