UFCW Local Unions Disappointed by Washington State Supreme Court Ruling to Allow Albertsons Massive $4 Billion Dividend as Part of Proposed Mega Merger

“We are disappointed to see a ruling that favors a small number of ultra-wealthy shareholders over the many thousands of essential workers and millions of Americans who will be left to suffer the consequences of the outright financial looting of Albertsons. Despite this setback that allows the $4 billion dividend to be issued, the delay allowed the United States Senate to scrutinize the dividend payment as well as the mega-merger, and alerted the public to the disastrous consequences if the merger were to go through. We applaud Washington State Attorney General Bob Ferguson and his staff for their efforts fighting to protect our members and the communities we serve. Our unions will not stop working to protect our members and our communities from the harmful impacts of this proposed mega-merger of Kroger and Albertsons. It is now even more important that the Federal Trade Commission take swift and decisive action to block the acquisition.”

Background:

From the first day the proposed merger was announced, UFCW Local 5, UFCW Local 7, UFCW Local 324, UFCW Local 367, UFCW Local 400, UFCW Local 770, UFCW Local 1442, UFCW Local 3000 and Teamsters 38 have been taking action to intervene and stop this devastating deal. 

On November 1st, Washington state Attorney General Bob Ferguson filed a lawsuit in state court seeking to stop the payout and a temporary restraining order was granted through December 9th.

On Tuesday November 29 the US Senate Judiciary Subcommittee held a hearing to scrutinize the proposed Kroger/Albertsons mega merger, along with an alarming, up to $4 billion “special dividend” announced by Albertsons in connection with the merger agreement. In a letter to the Federal Trade Commission urging the agency to intervene, more than two dozen antitrust experts and local unions representing Albertsons’ workers decried the payout as “nothing less than an out-and-out looting of the company” and a brazen attempt to destabilize the company ahead of regulatory review of the merger. 

On December 9th, the Superior Court Judge in King County Washington ruled against issuing a preliminary injunction, but delayed the effect of the decision until December 19th to allow time for an appeal by the WA AG to be considered by the State Supreme Court. On December 16th, the WA State Supreme Court issued a ruling granting the State AG’s Injunctive Relief and extended the Temporary Restraining Order on the Albertsons dividend until further order of the court.

Senate Hearing on Safe Staffing Law a Huge Success!

This week UFCW 3000 members and our allies at SEIU Healthcare 1199NW and WSNA, along with community supporters, made our presence known at the State Capitol during a state senate hearing on Safe Staffing bill SB 5236. Health care workers testified during the committee hearing and met with lawmakers to ensure they know how desperate the staffing crisis is—and how important it is to pass statewide safe staffing standards now.

Less than one year ago I provided testimony on House Bill 1868 hoping the state would pass a law ensuring nurses and patients have a safe healthcare environment. Instead, staffing got worse,” said UFCW 3000 member and Providence Everett emergency RN Kelli Johnson to the senate committee. “The shortage is not nurses, the shortage is safe work environments. No amount of money can keep nurses repeatedly experiencing moral injury and burnout, two of the top three reasons nurses leave the profession.

We are not alone: Firefighters, mental health advocates, rare disease patient advocates, and others also testified in support. And more than 2,000 people signed in “Pro” in support of the bill, more than twice as many as those opposed!

This week the coalition of healthcare workers from UFCW 3000, WSNA, and SEIU 1199NW, relaunched the WA Safe + Healthy campaign and Senate Bill 5236 to pass safe staffing standards to address the worsening hospital staffing crisis.

Bargaining

We are at a standstill with bargaining. We have proposed all of our noneconomic proposals and sent over our first economic/wage proposals but heard nothing back from Management. It has been over a month since we have seen any substantial proposals or progress from Management, and they have cancelled the last two weeks of bargaining that we scheduled. It is time for Management to get serious, listen to us the workers and come to the table with substantial proposals that will address our issues.

We come to work, day in and day out and work extremely hard to take care of our patients and community. It is time for Management to respect us and take care of us. Please keep an eye out for more information about our next steps. We need to take action and let them know that we are united and ready fight for what we deserve!

Kronos Outage

Last year there was a Kronos outage and Management overpaid many of us and then took money out of our paychecks. Our union in partnership with the other unions sued Multicare and won the lawsuit. However, now MultiCare has rejected the courts ruling and is in the process of appealing the Judges decision. The Three Unions have demanded dates to bargain with Management and continue to work to find a resolution.

Staffing

While we are fighting for strong staffing language at the bargaining table, we also recognize staffing is a huge issue everywhere. Whatever language we win in our new contract will not solve the chronic staffing issues and mismanagement that continues to plague Covington Medical Center, no amount of money could fix that. We need to continue to elevate the pressure by submitting official complaints to state agencies and fight to pass legislation on staffing. While we were very close to reaching a Tentative Agreement we caught some mistakes in documents that the Employer provided to us and we were unable to continue until those were investigated and taken care of. We are still confident that our hard work at the table will help win a contract that address economic justice and strengthen our Union within the workplace.

We believe it is time that ALSCO hears our voice!

We have been bargaining with ALSCO Linen since September 2022. During that time, we have won improvements to layoff language, access to new employee orientation, extension to the grievance timeline, and reinstatement of seniority to previously laid off employees during COVID.

We have not been able to reach an agreement on several items including wage increases and benefits. ALSCO continues to propose below market wage increases, passing on health insurance premium costs to workers, and refuses to improve the retirement pension.

We believe it is time that ALSCO hears our voice! We want a safe workplace and want management to show their appreciation for our hard work.

We will be voting on ALSCO’s last proposal on January 17.

We are recommending a “NO” vote.

The fight's not over: We’re heading back to Olympia to address the staffing crisis

We haven’t given up the fight for safer staffing. Last legislative session, we made momentous progress in elevating the staffing recruitment and retention crisis to lawmakers, media, and the public. Unfortunately, we weren’t able to secure safe staffing standards in 2022. But we know the crisis hasn’t gotten better – if anything, it’s gotten worse.

We’re gearing up now to take the fight back to Olympia and do what it takes to make sure healthcare workers have the staffing they need to provide excellent care. We look forward to sharing more policy specifics soon. But we need you to keep fighting, too.

  • After last week’s snow and ice storms, and the ensuing chaos about working on December 23, 26, and 27, we met with ACME Farms to talk about the pace of negotiations, emergencies like last week, and the upcoming busy season. We clarified that:

  • We wanted to pick up the pace of negotiations (while acknowledging scheduling issues on our side of the table) and now have bargaining scheduled on January 9 and 27, and February 3 and 17.

  • We wanted good faith negotiations that would bring us a fair contract to vote on, rather than a series of small agreements on issues that were Management’s priority.

  • We wanted clear communication about emergency situations as they evolve and other things that are important to us (like our pay).

Management talked about the need for more help during the upcoming business season and to deal with incentives for unscheduled shifts. After our meeting with Management, we talked about how to secure incentive pay for us and to make sure that Management didn’t replace union workers with temporary hires.

We are expecting a full set of counter-proposals when we meet again on Monday, January 9. We will have a full report on negotiations and what our next actions will be at our next Contract Action Team (CAT) meeting that same day.

Oversea Casing - Contract Vote Meeting Scheduled

WhidbeyHealth - We Have Reached a Tentative Agreement!

After months of bargaining over wages, we were able to reach an agreement with WhidbeyHealth management. In the Support Services contract and Pro/Tech/LPN contract, it states under the “Classification and Rates of Pay” article that the Union and Management will reopen the “Classification and Rates of Pay” article and bargain over wage increases for 2022. 

On August 2022, Management implemented a wage increase for some classifications while we were in bargaining. We told Management that the increases were not equitable and they needed to provide additional wage increases to the entire unit. 

After much discussion, we were able to win wage increases for all classifications, eliminate all “zero” steps on the wage scales, and increase some premiums. We will be going back to the bargaining table in 2023 to bargain the full contract and continue fighting for better wages, benefits, and working conditions. 

Our next step will be to vote on the contract! We will be holding an online vote on January 5 from 9:00 AM to 5:00 PM for Support Services and January 6 from 9:00 AM to 5:00 PM for Pro/Tech/LPN. You must be union member in good standing by the start of the online vote and have an accurate email on file with UFCW 3000.

We have reached a tentative agreement! 

On December 8, we reach a tentative agreement with Bornstein Seafoods Management. When we first started bargaining, our goal was to win competitive wage increases. The daily work that we do is hard on our bodies and the reason Bornstein Seafood is profitable. 

We continued pushing the Company and were finally able to settle on competitive wages, improvement to health insurance, holidays, and vacation time. 

We were able to win the largest wage increases in the history of negotiations with Bornstein Seafoods. We will be going over the details of the agreement during our in-person vote on Tuesday, January 3 from 3pm - 5pm at Squalicum Boathouse.

Dawn recently attended the 2022 Safety Summit with a cohort of coworkers from her store and is excited to continue to grow as an effective advocate for her & her coworkers’ rights on the job. Dawn is passionate about the arts and sports (biggest Seahawks fan around!) and loves spending time with her family.

About Our Bargain and Contract:
We continued pushing the Company and were finally able to settle on competitive wages, improvement to health insurance, holidays, and vacation time. We were able to win the largest wage increases in the history of negotiations with Bornstein Seafoods. We will be going over the details of the agreement during our in-person vote as soon as it is rescheduled.
